Jeanine Bird: The Australian Constitution. Section 100.
The Commonwealth shall not, by any law or regulation of trade or commerce, abridge the right of a State or of the residents therein to the reasonable use of the waters of rivers for conservation or irrigation.
The Water Act 2007 is Commonwealth law that enables the Commonwealth to manage all the rivers and water therein in the Murray Darling Basin. Therefore, it appears that the Water Act 2007 contravenes the Australian Constitution.
